Three Situations That Might Qualify for FMLA

The Family Medical Leave Act is federal legislation that allows a person to take up to 12 weeks of leave for certain medical reasons. To be eligible for FMLA, the worker has to have worked on the job for at least 12 months and completed at least 1,250 hours within that year. These are three situations that may qualify you for an FMLA leave:

The Birth of a Child

You will be eligible for FMLA if you are pregnant and getting ready to have a baby. In some situations, the other parent will also be allowed to take a leave, as well. Your FMLA leave can start up to four weeks before your due date for the child's birth.

A Medical Condition

A serious medical condition or physical ailment can qualify you for FMLA leave. For example, you can go on such leave if you break your leg, or you come down with a case of pneumonia.

A Mental Health Condition

A mental health condition could also qualify you for FMLA leave if it is serious enough to require you to take a break from work and medicate yourself for a while. Conditions such as anxiety, depression, and extreme stress can very well dismiss you from having to go to work for quite some time. You will need to see a reputable mental health professional to receive a diagnosis, treatment plan, and a return-to-work date of when your employers can expect you back.

Now you know of a few situations that could qualify you for a lengthy FMLA leave. There is nothing special that you have to do to qualify for FMLA. You will automatically be eligible for it if you meet the criteria. Furthermore, you'll have to submit documentation that explains your condition, treatment, and estimated return-to-work date.
